Appeal Right for 2nd Application (URGENT!!)

Hi All,
I met a lawyer today who advised I can write to the Home Office to appeal for my Right To Appeal.
This is my second application and I was refused on the grounds that I have overstayed but this was not the case as I had applied well in time. As far as I understand you dont have a right of appeal when you re-apply and JR is the only option at this stage.

Can experts pls advise if the lawyers statement is true?
PLEASE HELP

NB: There was no break or missed time-frame in any of this periods.

Application History:
1st app: March 2013
1st Denial: May 2013
First Tribunal: Sept 2013
Appeal Denied and UpperTribunal Lodged: Oct 2013
New Application: Nov 2013.
Upper Tribunal Refusal: Dec 2013
Refused: April 2014
