During judicial review can we apply for tier 2

During judicial review can we apply for tier 2

Dear friends
I need your help to solve my problem.i got refusal this week.my psw is going to expire in august.i want to go for judicial review ,during that period can I switch on Tier 2 General.need expert advise.

Yes u can.But I think so it will make trouble for u.
Coz i been through the same situation.

My Tier 4 leave was valid when i applied for JR(Against tier 1 ent).During JR process i extended my tier 4 leave to remain.And its been approved.And after some days TSOL(HO representative) has sent me the letter mentioning this

I am instructed that on 27 August 2013 you were granted leave to remain as a student.
This claim is therefore now academic and should be withdrawn. on that basis l would invite you to withdraw your claim on the terms set out in the attached consent order-
lf you agree with the terms of the order please sign and return it to me as soon as possible so that I can file it at Court.


And my solicitor sent him a letter in response of this letter.And told him that the switching from tier 4 has been closed since 12 dec 2012.So thats why my client extended his leave to remain in tier 4.Coz he can not even make a fresh application in same category (Tier 1 ).
But in your case i think so it will make trouble 4 u .Coz U can make new application in same category(tier 1).But i m not sure.Ur solicitor can give u gud advice.
