IS PR HOLDER STILL EEA MEMBER?

Post by abam » Mon Apr 28, 2014 8:51 am

Hello everyone, I have a sister who aquired EEa2 as a dependant on his brother way back in 2005. And she obtained her Permanent Residence Card in 2010. Now she wants to bring her son of 16 years over here but we do not know either she can still use the EEA route or not. Can some one please throw more light on this issue for us please as we don't want to go through the one with £18,600 route. Thanks.

Of course she is still an EEA member and can sponsor her son.

I don't think she has to be qualified (i.e. exercising treaty rights) as she already has PR.

Thank you but some body told us because she has obtained the PR she is not dependent on the brother anymore therefore she is not qulified as an EEA member but ILR. Can I please know the difference between ILR and PR. I know they are all Permanent Residence but what are the benefits of each of them.

As far as I know, there's no difference between them really, apart from the name. PR (EEA4) is on the EEA route but ILR is through the UK Immigration Rules.

Hope someone else will come and give their ideas.

She cannot rely on EEA route, as she is not an EEA national.

As she has secured PR, she can sponsor her brother via the immigration rules.

If the person was a non EEA spouse of An EEA national, and they are still married, then the spouse can spouse the non-EEA child through the EEA national, but this does not apply to Extended family member.
