ILR continuous period calculation issue

Post by om.feb26 » Mon Apr 28, 2014 2:37 pm

Hi,

I am on tier 1 general visa which was granted from 5th december 2010. I entered in uk on 24th december 2010. I have got first extension from 20 dec 2012 to 20 dec 2015. In this period I was away for more than 180 days for marriage and other reasons, which was from 4th february to 10th august 2013.

I am going to extend in apr 2015 and hopefully will get a 2 year visa till 2017.

Now looking at continuous period requirement for ILR it says that no continuous 180 days absence in an year. does it mean if I apply for ILR at a time where I can divide these 180 days between two years then will that break continuous period rule. for example if I apply in may 2016 for ILR then below table will explain my absences

1 may 2011 - 30 apr 2012
1 may 2012 - 30 apr 2013 89 continuous days absence
1 may 2013 - 30 apr 2014 95 continuous days absence
1 may 2014 - 30 apr 2015
1 may 2015 - 30 apr 2016

Please reply about will it break continuous period law or I am happy to go. Would I be able to apply for ILR?

Thanks a lot
Om
