EEA citizen married to British Citizen

Post by jonesa7777 » Mon Apr 28, 2014 10:04 pm

Hi
I am Polish married to a British Citizen. I have lived in the UK for nearly 11 years, have registered for WRS then applied for permanent residence and received the card. Since I am married to a British Citizen I thought it will be easier to apply on the basis of that as I need to show only 3 years rather that 5 or 6 (less paper work to prepare etc.). I am a bit confused about some sections of the form. While the section 2.2 mentions only 3 years to account for for the residency requirement but 2.4 asks again for the last 6 years, so unsure if the section 2.4 applies to me at all, do I only provide 3 years of address history there or still 6 years?
Also, could somebody help me with the section 3 of the documentation. It states here:
SECTION 3 Evidence of lawful residence during the5(or, if the applicant is married or in civil partnership to a British citizen, 3)
years before the date of the application: required for applications made on the basis of residence in the United Kingdom:
required for all applicants
• Your passports OR
• Letters from employers, educational establishments or other Government Departments indicating presence in UK[/u]
[/i]
How can I prove residence on the basis of passport? Why passports in plural? Does it mean mine and my husbands??
What letter do they mean, specially written for the purpose of the application e.g. by employer to confirm that I have been residing etc. or different random letters from different dates confirming I have lied here?

Any help will be greatly appreciated!!

Sections 2.4-2.6 are not required as you hold PR card. You can skip them.
Normally a passport (one that covers the relevant period) is enough to prove residence. With EEA nationals sometimes the HO requires further evidence (as passports are not stamped).

I would just apply using your passport + PR card, marriage certificate and partner's British passport. yout also need to pass the LIUK test and meet the English language requirement.
