Post by nafeesakhtar » Wed Apr 30, 2014 6:57 pm

My friend is overstayed but he is in true relationship with a British .She is unmarried partner of him. They have been living together for last 2 years. They have evidence to prove it.
His partner is working part time only.

is he is able to apply as unmarried partner of British Citizen?
what requirement he needs to meet? what are the chances of successful application?

Please advice

He should return home and apply for an unmarried partner visa from his home country.

They will need to meet the standard requirements - e.g. financial/language.

He should be cautious that he hasn't (as well as overstaying) worked illegally or used any kind of false identity. He should also ensure that he has no outstanding bills with the NHS.

I would consider marrying before leaving.

If his partner is only working part-time, it's unlikely they will meet the minimum annual income of £18,600.

Probably a very reasonable consideration.

Fair point Casa - I'd missed that.

So we'd have to add his partner finding a job which qualifies for the minimum income and working there for 6 months.

actually he already applied once and was refused .
HO asked him to leave the country and apply from Pakistan.
Secondly they have objection that he has not yet completed 2 years being living with her (co-habitation)
but now he has completed 2 years living with her.

Unless they have substantial savings?

Hi, im a British citizen and my partner is Nigerian who has been an overstayer since 2015. We moved in together January 2017. January 2019 is going to be the 2 year of which we could then put in our application for cohabitation. I had a job of which I was able to prove I was earning 18600 per annum. 30 Nov 2018 (Friday Gone) I was made redundant from work :( Now this means I have been out of employment for a few days and I am worried of how long it may take me to find another job. The problem is I have almost a year wageslips to prove 18600 earning however, since November has now been my last pay I am worried of what I can do. When I submit an application would I have to wait another 6 months to have the required income or would I be able to submit application based on the payslips I have up until November and prove I am working if I am to get a new job soon. I am really worried and don't know who to ask.
