ILR Eligibility - Advise Needed

Hi,

I need some expert advise on my eligilibility for ILR. I came to uk in Sept-08 on Work Permit Visa and went back to India in Jan-10 due to personal reasons. I re-entered UK in Jul-11on Tier 2 ICT long term visa (after a gap of 1.5 years). So considering the first time I entered UK I have completed more than 5 years but there was this big gap if 1.5 years in between. I have met couple of solicitors and one of them advised me that I am eligible for ILR whereas second one advised that the gap is too long and I stand no chance. Can someone please comment on this and let me know whether I stand any chance if I apply for ILR now?

Absences should be <180 days for each 12 month period.
