As per my understanding and previous posts, If you change your visa status from tier 1 to ILR then all depenents are not required to change their visa status, until their current leave to remain (visa validity) ends.MadNomad wrote:I am due to apply for ILR in June 2014.
Both my children were born outside UK. To minimize application fees, I want to apply together with my wife, but leave our children (both younger than 5) as Tier 1 Dependants. Can anyone advise if this is allowed from Home Office/UKBA perspective? The idea is to apply for their ILRs 5-6 months later when my finances stabilize. Otherwise our application cost will exceed GBP 6k (incl. legal fees).
My worry is that if the Main Applicant has switched her/his status to ILR from Tier 1 General, the dependant status of any dependants will be voided unless they switch their status at the same time. This could cause them trouble if we travel outside UK at any time.
Any informed opinions would be greatly appreciated. This is a big dilemma for me.
