HI All,

I am on psw and am planning to apply for student visa from a highly trusted college, which dont give me 20 hrs working rights. My wife will apply with me (in country) as a dependent. So even though i dont get working rights, will my wife get the full working rights as my dependent?

Can anyone please help me to answer my query. Thank you.

Only if you are studying on a degree/foundation degree for at least 12 months.

I dont think your dependent can apply for switching from PSW dependent to Tier 4 (General) dependent if institute is not HEI.

You wife will only qualify for leave as your dependent if you are government sponsored and studying a course of over 6 months duration or if you are studying a course of over 12months duration at nqf level 7 or above at an HEI Therefore a 'degree or foundation degree' is not sufficient it must be a postgraduate qualification at nqf level 7 or above.

Thank you all for the replies,

I am planning to study ACCA (Level 7) for 3years, in a highly trusted college. As its a college i will not get work rights, but will my wife get working rights if she applies along with me.

Your wife won't get work rights because she won't get leave to remain as your dependent.

I have already answered this twice. She won't qualify for leave to remain as your dependent if you studying at a non-HEI private college, therefore if she isn't granted leave, then obviously she won't have the right to work.

The answer to your question is no, but it is more serious then that, if you study at a private college, she will not be able to stay in the UK as your dependent.
