Kiwi with EU spouse

Post by Swingjune » Fri Jul 27, 2007 3:28 am

My Dutch hubby had started his IT job in UK, 3 months ago and I have just sold off our family home in NZ.

I planned to arrive in UK as tourist and immediately send out our EEA1 and EEA2 applications together - can I do this :?:

Better, if you can, to apply for an EEA family permit before you arrive. With it, you can immediately start working in the UK and getting a Residence Card will be a lot easier.

I lived in Auckland and the Family Permit is process in the British Embassy based in Wellington. I understand that I am required to send my hubby's passport as well .......... how on earth am I going to do that when he is holding the passport in UK :?:

In such a case, a certified copy of your husband's passport will do.

I agree. Have your husband go to a solicitor in the UK and make two certified copies of his passport. It will cost him about £5-10 per copy. One he can send to you, and the other he can submit as part of his Residence Card application.

In your cover letter to the embassy, explain that he is in the UK and so you are submitting certified copies.

I think you will have no problem with this.

Helps to check the entire picture out. The NZ embassy page does not include the scenario that the EEA national is already in the UK. For that check out this link,

http://www.ukvisas.gov.uk/servlet/Front ... 8721068382

where it says-
As a guide they should include:
  • proof of their relationship to you (for example, if they are your children, their birth certificates and your marriage certificate if it is your husband or wife)

evidence that you are in the UK, or intend to travel to the UK

a certified copy of your EEA passport, and

evidence that you have a right of residence in the UK.
