10 yr LR or T1 General Migrant

Post by faisaltanoli » Mon May 19, 2014 10:18 pm

Hello Amber or any senior member,

As I asked earlier, I have applied for ILR under Long Residency route on 28th February, but due to new regulation my wife (she is in UK pre-July 2012) will not get her ILR for 5 years. I am thinking to withdraw my application tomorrow and wait for ILR based on T1 which is due in Feb 2015.

Please advised me as soon as possible. I do not want to wait more five years.

Thanks

Regards

M Faisal

If you settle under SET(LR) and your spouse subsequently switches to FLR(M) from PBS dep, she'll have to wait 5 years. Perhaps applying as a PBS applicant would be wiser for your ILR, particularly as your spouse would only be subject to 2 years.

Thanks Amber,

I hope there is no more policy changing coming till next February 2015 as that is my biggest fear that by the time i reach to that point of ILR on PBS and they will bring more changes and barred my wife somehow for more five year.

Please advice me if you know any more consultation going on around changing rules.

Thanks

I'm not aware of anything but no-one know what happens with the every changing face of immigration law.

Thanks Amber,

So confused...can not make decision...some people says do it...other says do not do....what if you get point, what if policy changes...its sort of comparative analysis of advantages and disadvantages... I do not know what to do... :(
