Explanation about naturalisation

Post by Laila85 » Mon Jun 02, 2014 3:11 pm

Hi all,

I want to apply for my naturalisation in July and need some advice.i came to the UK as a dependent of Tier 1 in 10/08.i was granted my ILR on 11/12.my husband recently received his British passport and now I want to apply as a spouse of British citizen(3 years basis).
My questions are;
1. in the last three years I have been out of UK for 292 days and 0 days in the last 12 months,I have 22 days more(then 270).i can not wait any longer as I want to apply for a job which involve frequent travelling and that is why I need British passport.
2.do I have to apply for discretion or as the guidance say they will ignore up to 300 days without asking for discretion,is that every one gets this or only special cases?
3. I want to apply through NCS and after applying I want to go on holiday for a month,is that OK?
4. Do I have to tick 6.7 page 15 declaration which states"although I do not meet all the requirements for naturalisation ........."

Many thanks

Laila

It is a tricky one. One one hand if absent for less than 300 days in the last 3 years the absences should be disregarded, as HO states and especially as you had no absences in the final year.
Personally I would apply for discretion as I can not see it harming you and I would like to see what senior members think about this one.
I had 122 days of absences in the final year, I applied for discretion and had my approval within 8 weeks.
Once you apply via NCS you are free to go.
I am sometimes wrong.
