Tier 1 Dependent-Child born in UK

Post by nks » Wed May 28, 2014 10:04 pm

Hello,
In light of Tier 1 extension closing in April 2015, I would apply for extension 10 months before my current visa expires in Oct '2015. Earlier, we also got visa for my dependent daughter born in UK, which is also valid until Oct '2015. I have two queries in this regard, which I tried to search answers for but no luck (at least for one of it):
1. Can I just apply my visa and defer dependent visa extension until Sep '2015?
2. I know child born in UK doesn't need visa if not travelling out but if they do get a visa to travel out, do they also need to extend it in time before expiry always?

Appreciate your replies and any references where policy regarding this is stated.

Thank you,
nks

Hi,
I m in a similar situation ,applying early ext.as for the newborn you can defer the babies extension till sep 2015.since dependents can extend even after April 2015.
Hope any gurus can also confirm it.

Thanks. Does someone have opinion on my 2nd query. If child born in UK doesn't need visa until she needs to travel out of UK, but if she gets a visa, which then expires, can she again continue being without visa until she needs to travel again?

You are correct, however; a child who never gets leave can never be considered an overstayer.

Thanks amber. Does this mean if child born in UK does get a visa, she will be considered overstayer if the visa is not renewed in time?

Yes they would, however; this would not affect an application to register under section 1(3), subsequent to either parent being settled.

Hi,

My visa & Spouse visa ends on Dec 2015, I'm thinking to apply first main applicant visa now and then apply for dependant later when they are near to expire. Can this be possible ? if yes, then how soon i can apply, is there time bound to apply. I know the extension will be closed by April 2015 i.e, which 8 months early for us, but are we allowed to apply a year and a half early. Please let me know.

Also my child has born in UK recently, so can i wait for visa to be done later on until my extension is done. Can we do this, please let me know on this.

I dont want spend money for 6 months child visa and then reapply for extension before april 2015. Please help me.

Thanks,
MSM

I am in same situation as CtrlF9.

I and Spouse have valid tier1(extn) till Dec-2015. I want to renew only my T1(G) before Apr-2015 cut off.
I will apply for spouse T1(Dep) before Dec-2015.

Is that ok? Any good ref or link is highly appreciated.
