Dependent ILR

Hi

Different people giving different views, can someone please advice shall I able to apply ILR my wife based on below:

Tier-II dependent visa granted (out side of UK) on 11th Jun 2011 and is valid until 18th Apr 2013
UK arrived on 30th Jul 2012
FLR renewed in the UK on 18th Apr 2013 and is valid until 26th Oct 2014
Main applicant has been qualified and applied ILR on 13th Sept 2013 but she remains as PBS dependent as she has valid leave to remain until another year or so.

Based on the above dates, can I apply ILR to my wife on or after 03rd Jul 2014 (as she has been issued her visa on before 09th July 2012) or else she need to apply FLR in Oct 2014 and need to wait until she spend 5 years?

Please confirm,

30th Jul 2014 on SET(O) if she's still a PBS dep. B1 English and LIUK required.

Will that mean can we not able to apply before 28 days?
