I am helping a female friend who is on a lower rate of disability and claiming ESA( I think income based) but she is only in her assessment phase awaiting a medical.
Currently she is getting about £144 per fortnightly plus her rent is paid and council tax.
So her weekly ESA income is £72
Disability is £21.50 a week
Rent is £75 a week
Council tax is £26 a week.
Using these figures I see she doesn't satisfy the criteria under the requirements as per Ahmed [benefits; proof of receipt; evidence] Bangladesh [2013] UKUT 84 [IAC] and the Immigration directorate instructions Chapter 8, Section FM 1.7A – Family – Maintenance (include a copy) at page 3, paragraph 5.2.
I suppose once she has had her medical she will be placed in one of the 2 groups and her ESA will increase to £103 or £108 depending on in which group she is assigned.

Furthermore, she has savings of £600 which would be an additional tariff income of:

£600 divided by visa duration of 130 weeks (2.5 years) = £ 4.61 per week


She will have to wait after her medical to see what happens. Are you able to make any comments as to what kind of paper work we need to get ready for her husband's application to join her in the UK from Pakistan. Her previous application under the old rules was unsuccessful. There are no children.

Please excuse me if I am posting my query in the wrong place, but I am new. My query; I have two British sons from my first marriage. I have remarried and my husband has one dependant son. I am their sponsor. Would the calculation of adequate maintenance include my two British sons or will it just be me, my husband and stepson? If my two British sons are exempt from the calculation, please direct me to where I can find this exemption.

Could you please advice on this

As I told you my wife claiming child benefit and she use to receive workin tax credit and child tax credit , in middle of March they stoped her working tax credit n they sent letter overpayment of £5000, we sent appeal form and two weeks ago she sent the renewal pack form, my appointment for ILR on the 10 June witch is next Tuesday, my wife was on fone to HMRV today and she been told that her child tax credit will increase from £70.23 per week to £115
And she will start receive working tax credit £14 per week, her she gets paid every Thursday , now as my appointment on Tuesday shall I tick that she receiving working tax credit on SET M Form or not? We didn't receive any letter to say that she get the working tax credit again yet!

It's getting confusing now!
As I mention my wife working tax credit ws stoped on March and sent us overpayment letter my wife still receiving child tax credit,
Now it's gona get complicated, my appointment next Tuesday the 10 June, my wife sent the renewal pack last toe weeks for the working tax credit, we still didn't receive any post from HMRV, but 3days ago my wife was on fone to HMRV and they told her from next Thursday the 12 June she wil start receiving working and child tax credit , I checked my online banking last night and I see that she got payment yesterday Child and working tax credit !
Now help me out shall I tick that she receiving workin tax credit too? Even if I didn't receive letter from HMRV confirming that?

Set m Finance Requirement

Take the last 3 wages slips, add them together and divide by 3.

I put the date I came on spouse visa not the day I came on tourist visa and overstayed ? Correct?

I have calculated my adequate maintenance and I need

Income Support Couple £113.70 (£492.70)
3 Children 66.33 x 3 £198.99 (862.29)
Family premium £17.45 (£75.62)

Total I need to show is £1,4306.61 after Rent and Council Tax.

I have a full time job and earn enough to meet the Financial Requirement. My question is:

I am self employed as well and have just given details of my income for April 13 to April 14 to my accountant, for personal tax purposes.

1. Can I use income from self employment towards calculating adequate maintenance?

2. If so, should I use last financial year's income April 13 to April 14 or this current one April 14 to April 15.

3. I receive Child Support via the CSA for my two boys, can I include this?

Could you confirm about the question
How long have you lived in the Uk?
Is it from the day I came on spouse visa? Or the day I came on visitor visa 2003 and overstayed? I left the uk on 2010 and applied for spouse visa back home

Q2- about the working tax credit and child tax credit
I tick the WTC as my wife got payment on the 6 but still didn't receive letter to confirm it and also I haven't receive the bank statement for this month to show it,
Would that be issue?
