Question Surinder Singh route to Ireland

Post by Thaimover » Sun Jul 06, 2014 5:50 am

Hello to all, newbie here with some questions, hoping to find answers.

So I have been married for 7 years to my Thai wife, we have 2 kids both with British passports.
We went to the UK early this year and have decided we'd like to bring our kids up in the UK.

I have been living in Thailand for 11 years..
So I don't meet the necessary for getting the wife to the UK so we want to go the Surinder Singh route.

I think Ireland would be best, work there for around 3 months to 6months and then do what is needed, this is what I don't know.

1) What visa does my Thai wife have to obtain? (we live in Thailand and have 2 young children both with British passports)

2)When in stay Ireland with said visa for say 3-6 months, what has to be done then to get this 'EU residence permit' and how long is it for?

3)Where is the above done, in the country we're living in?

4) What other things do we need to do in both Ireland and then when we finally get to the UK?

5) Could we maybe fly to the UK first on a UK visit visa, then the wife apply for the correct visa while in the UK for Ireland or does it need to be done in Thailand first?

6)Or with the visa granted for Ireland would his be ok to also enter into the UK?

SO many questions I know, but thanks for anyone who can help.

Just a quick thing, I have noticed that Ireland isn't part of Schengen, does this make any difference?

No, it's part of the EU.

Bear in mind the rules have changed recently - i.e. tightened up, it's no longer a case of hopping over for a few months and moving to UK, you have to switch your 'centre of life' totally, and feeling is that means around 12 months, with permanent jobs, leases, property etc, whatever is needed that makes it look like you didn't do it to circumvent UK immigration rules...
