PBS dependant to ILR dependant

Post by enrules » Sat Jul 26, 2014 3:27 pm

Hi,
This board is extremely useful but I still haven't managed to get my head around my issue. I got my ILR this month as a Tier 2 (PBS) 5 year route. My wife is on a Tier 2 dependant visa since March 2013. She is a doctor and hence her visa has restrictions on her working as a doctor. I have a few questions:

1) Is my wife now eligible to apply as a ILR dependant on FLR(M) form? This would allow her to work as a doctor without restrictions.

2) Is she eligible to apply for ILR on 2 yr qualifying period in March 2015 or it is 5 years?

3) If she does apply as an ILR dependant on FLR(M) will this reset her qualifying period or will the time she spent in UK on Tier 2 dependant visa count towards this?

Would appreciate your help.

Thank you,
Nabil

1. Yes. Subject to Appendix FM-SE.
2. 5 years (319E(d)(ii)), if she didn't switch.
3. Reset.
