ILR Shortfall Question

Post by jamal80 » Tue Jul 29, 2014 11:26 am

My wife currently has a pending ILR (Set O, PBS dependent) application with the Home Office. When she applied, she had a shortfall around 4 weeks before she would be eligible for ILR. She meets all the other criterias. We still decided to apply for it rather than extension or varying the application.

The shortfall has been completed inside 1 and half months ago, and we are still waiting for a decision. My question is that would they reject the application on the basis that we applied early at the time?

Has she done her biometrics?

There are few examples when people successfully submitted early applications

Query - 24 days shorter for 10 years Long Residency – ILR

Urgent Help Required-ILR when delay in travel for 3 mon 1 da

Shortfall of 28 days before ILR Application

ILR ELIGIBILITY - Email from UKBA

Short of 40 days for Long Residence 10 years

I have made another thread on this topic if you want to join in:

Yes she has done the biometrics. I will look into the threads, my thinking is that the immigration status is still considered the same for my wife before a decision and the time has been completed while the case is under consideration.

Also if they grant ILR, the date of the start of the ILR will be the date of the decision date, not the visa expiry date, right?

That's good thing, shows the application is valid.
