Step kids visas

Hi,

I posted in here a few months back about problems with getting my step kids into the country. After 18 months of stress and hitting our heads against a brick wall we had some great news last May that the visa section in Nairobi admitted that mistakes had been made in processing their documents and granted them entry clearance. A week later they joined us here in the UK.

The kids were granted the same visa as my wife which is finishing in October this year (she has a spouse visa that was applied for prior to the July 2012 rules coming into effect). She will be applying for ILR in the next couple of months and my step daughter will be following her as a 13 year old.

Unfortunately although we applied when he was only 17 my step son is now 19 and has only been in the country for a few months.

Can anyone tell us if there's likely to be any problem with his next visa application, can we get him in under ILR as an adult dependent relative, he's applied for a local college to complete his secondary education (BTEC or A-Level).

We've been fighting for so long to get them here, sending complaints ourselves or through our MP to various people, we couldn't bear to be torn apart again.

He should be ok as applied before he was 18 insofar as he is not living an independent life. B1 English and LIUK required. He should apply with the Mother and child.

Thanks Amber,

He's doing the 2 tests at the end of this week (so fingers crossed). Do you know if he'll be eligible for ILR along with my wife (finishing her 2 year+ spouse visa) or will he be extending his limited leave to remain visa?

Also I know that we'll be having to pay for his visa seperately, but do you know if my step daughters fee is the full whack, it wasn't previously but they seem to have changed the rules this year?

They should apply for ILR together. The fees are detailed on SET(M).

Wow, that's quite a lot :roll:

The set(M) form says I can't include dependants over 18.

I meant apply together at the same time, not necessarily on the same form.
