Applying for partners first visa. I'm claiming carers allowe

Post by lynzi1984 » Fri Aug 08, 2014 12:14 am

Hello I am new here.

I was wondering if anyone can help. My partner came to uk illegally 10 years ago, we have been together for 4 years and in may this year we were married.

My question is I want to apply for visa so that he can stayin this country and eventually work. I have a disabled son and I receive carers allowance for him as well as earning 90.00 a week. I have been reading up that I must show adequate money remaining after paying housing costs of 113.70 a week, (income support for a couple ) my question is, to receive carers allowance you have to earn under 100.00 a week. I receive 90 from earnings and 61.35 a week carers allowance, my rent equals 126.92 a weeks lido not have 113.70 a week spare. I am currently awaiting a tax credits decision after applying in joint names, so I'm unsure at moment how much that would be and I receive child benefit of 136.20 a month and 3.33 a week child maintenance, but I have read that you cannot use benefits to calculate earnings I have no savings, is there not a way I can use benefits to apply as otherwise I feel I am being discriminated against because I have a disabled child, I can't win I can't earn more than 100 a week or I lose my carers allowance if I lose my carers allowance I would have to earn 18600 and I can't do that as I spend so much time caring for my son,

Any help on this matter would be much appreciated thanks Lyndsey

P.s I am British citizen and have lived here all my life my children are from a previous marriage, also could I apply on the basis that he has a parental role with my son and that removing him from my sons life would be hugely upsetting for him and against his human rights, as I was advised I could
