Dependent Family members application

Post by KTL88 » Fri Aug 08, 2014 5:25 pm

Hello everyone,
i am a dependent Family member living in the UK. i had a 5years resident permit recently(in july 2014) while depending on my Mother's French Nationality. My girlfriend who has a student Visa is giving birth soon. Her Visa terminates in December 2014.My concern is the following;
- Being a dependent family member can i change my Partner's status?. we live together since 3month now and intending to get married after the birth of our child
-if this is possible, what are the requirements i need to put together to apply for my wife?
- will my unborn baby have a family member status?

Thanks very much for your replies

It is a highly complex case.

You cannot sponsor your wife unless you secure Permanent Residence.

I believe your child will be able to rely on your mum, just like you, and then a Human right case will need to be made outside the rules, but you cannot support your partner directly.

Are you presently working? If it came down to it, will you be able to show that you will meet all the rules as a settled spouse, save for the fact that you are not settled.

Are you French?

Not sure he is. He obtained a 5 years residence permit as a dependent family member of his mum, which is unlikely to be the case if he was French, although a Registration Certificate may be a possibility.
