Out of Country Spouse Application Process (Senegal)

Hi,

I would be really grateful for some help and advice.

I am currently living with my Senegalese partner in the UK and I am a British Citizen. My partner has just had his unmarried partner visa application refused as he is an overstayer and we could only provide evidence of living together since Dec 2013.

We have come to the consensus that our only option for a 'normal' life is for him to return to Senegal and for us to get married there. However, I am getting really confused about what needs to happen and wanted to be prepared for when we receive the final 'get out of the UK or else' letter from the Home Office.

My understanding so far is....

1. I will need to obtain a Certificate of Non Impediment Certificate from the Register Office
2. This will need to be translated and legalised at the Embassy of Senegal in London
3. To get married in Senegal I will need to produce this document and my passpart and he will just need his passport
4. Once married we would need to take the marriage certificate to the Ministry of Foreign Affairs in Dakar to be certified
5. We would then take all the evidence to the British Embassy in Senegal to make our application for him to join me in the UK

What I am asking is if this is the correct procedure and also whether I need to make any application in the UK (or do we just submit the one application in Dakar?).

Also, does anyone know the cost and timeframes associated with this? Is this a complicated process and do you know if his overstaying will go against him?

Any advice, guidance, information will be appreciated so thanks in advance :-)

You can get married in the UK.

The evidence of 8months relationship is wholly inadequate.

Can you please explain what you mean? You think we could get married in the UK?

Also, are you saying that 8 months of living together would be a refusal for him to come back to the UK?

I meant 8 month for the purpose of an unmarried partner visa.

He does not require leave to get married, provided he has ID.

Oh ok...thanks very much.

If we married here would he still need to leave the UK to apply for a spouse visa as he is an overstayer? Also, would I tell the Registrar about his status or just ignore it? I don't really want the UKBA coming to take him away during the ceremony :-)

I have started the process of getting a Certificate of Non Impediment and trying to work out options so sorry for all of the questions....I can understand why there are restictions but for genuine relationship it really puts the pressure on and it is so confusing.

I have just been looking at the online process via the visa4uk but dont think that we could start this process until we have a marriage certificate so it looks like we will have months apart :_(
