Registering child as British Citizen

Post by Shwethakt » Sun Aug 17, 2014 12:26 pm

Please can someone advice me about registering my son as British Citizen. My son is 4 years old and he was born in India. He has been in UK for 2.5 years and 1.5 years in India. Child applied for ILE from India and he received ILE in March 2014. Child staying with mother and father in UK. I, mother have ILR for more than 1 year. My husband recently was naturalized as British citizen. Husband got naturalized after 5 Years being in UK under Tier 2 ICT and 1 year ILR. I don't have plans to get naturalized as BC.

1) From what I have read, the child needs to be registered as BC under discretion section 3(1) . Please confirm that is what he needs to be registered under as BC.

2) Child is starting his reception year in school from September. Who can sign as referees as currently no one is professionally involved with child. Does a child of his age need anyone professionally involved with him to sign as referees.

3) Section 4 Good character requirement. This need not be filled as child is only 4 years old. Please confirm this.

4) As far as I have read there is no requirement saying that the child should have been in UK for such and such period. Even though the child received his ILE in March 2014 I don't have to wait to register him as BC till he completes 1 year under ILE as the father is already naturalized British citizen. Please can you confirm.

Thanks,
Shwetha
