good evening guys and gurus

just wanted to know if someone have applied for ILR(LR) and got refused due to gap of more then 28 days.
wanted to know what have they done for it and if they have succeeded or not.


i have a gap of 92 days due to home office not taking the fees for the first time and then refuse second time due to me sending the bank statement with not enough money in it and then got visa granted, in 2009, BUT i managed to get a letter from barclays stating that i had enough money in my account and there was no attempt from home office of taking the payment.

i am going through solicitor so that i have full legal support from start.

would really appreciate all you guys help

You need to explain a bit about your immigration history and reason of gap.

You could argue that there was never any gap if the Home Office's failure in taking the initial payment was their fault.

that is what i wanted to know through this forum, that if someone had similar situation like me and won the case, my only worry is if JR is gonna allow my appeal if it gets refused by home office, as from one of your other answers, i got the case of Basnet VS Secreteray of state,which is 99% similar to mine and is in 2012,
i your opinion VINNY, what are the chances as i have the bank letter to prove that it was not my fault, and according to SAR report the attempt to take the payment was only once, they didn't even tried it again.
