Resigned- can I still apply
Keep finding hurdles and just want to put this application in.
I am the UK sponsor for my husband. I am moving back next month. I have already resigned and my last working day is 20th September .
Am I right in thinking that I need yo apply before my last working day so I am still employed at time of application.

I have a job to go to in the UK.

Will they check if I am still employed?

The application will be refused I'm afraid, it will be refused because
1.You need letter from your employer stating you're an employee and your income,as you've resigned they obviously can't say you're an employee.
2. Checks will be conducted even if you get the letter and your employer will obviously state you're no longer with them.
Moreover,you wouldn't know when your application will be treated by an ECO,

So how are people supposed to prepare to return to the uk and what employers are gonna give a job offer and just wait.

Another sleepless night for me then.

No point applying at all then?

You'll be fine Ok,just calm down. This is what the stupid law is making everyone to go through, but I can assure you that there's no way they can refuse you if you follow their stupid laws to the letter,the prize to pay is simply time!
I'm of the opinion the law is kind of design to break and discourage people marrying who they really want,you should just be determined never to give up.ask anything not clear and ppl will be of help Ok.
Why not send the documents to your hubby instead of you going there?just a suggestion though.

Unless I'm mistaken, I believe you are saying you are employed outside of the UK and have resigned from your job ready to return to the UK and take up another. Am I right? If you have been earning the equivalent of at least £18,600 and have a confirmed job offer earning a minimum of £18,600 in the UK to start within 3 months, you will meet the financial condition. Better to submit the application before you leave your current employment. You should also submit the contract or written offer of UK employment showing a start date.

Yes!

Sorry if I wasn't clear, I am in Dubai, have a job offer in the Uk to start in November. Here we have to give 3 months notice, so in order to be ready I am working my notice and last day 20th September. Am I better being honest and telling them or just press the submit button befor ethe 20th and hope all is good.
Its unlikely HR will give me a letter without writing my last working day on it though.

Yeah, i don't think it will be a problem at all.

You will be fully covered by Category A , provided you can show you will be coming to a work in the UK with in 3 months, as was correctly stated to you by another poster, earlier.

Should I say in my cover letter that I resigned ready to go to UK n mention my last working day or not say anything???

With regards to returning to the UK it does say you must be employed at the time of application as well having the job offer in the UK.
5.2. Category A: With current employer for 6 months or more – overseas sponsor
returning to the UK

5.2.1. Where the applicant’s partner is returning with the applicant to the UK to work, they must
meet two requirements to rely on Category A:

 First, the applicant’s partner must be in employment at the date of application and
have been with the same employer for at least 6 months prior to the date of
application.
I don't know if they will check your employment status.. I changed jobs whilst my husband's application was being processed which was a gamble but it paid off. The only way I can see round it is applying and sending your documents off ASAP and not mention the resignation.

I am actually in the UAE on a career break and am still officially employed in the Uk. I have a letter from my UK employer to say this. Gonna do online application before my last working day here tho, I think they are going to be more concerned with my job at home.
