Naturalisation non EEA spouse of an EEA National

Post by pun_see » Fri Sep 19, 2014 9:00 pm

Hello all,

I'm a Hong Kong citizen and have been married to my Czech husband since late 2008. He was a PhD student from 2006 till Sept 2011 and is employed full time since April 2011. We've been advised by a lawyer after I got my spouse visa back in Oct 2010 that because the PR process is quite complicated and as we are entitled to live and work in the UK regardless, it is best to apply for Naturalisation once we are six years into our marriage. We had comprehensive sickness insurance till Feb 2010.

It is fast approach six years of our marriage, however a recent discussion with the lawyer revealed that we will only be eligible to apply for Naturalisation six years after my husband's full time employment has commenced. This conclusion was based on the fact that we had no comprehensive sickness insurance between Feb 2010 and April 2011, the start of his full time employment.

Does that mean that we would have to wait until April 2017 to apply for Naturalisation or is there another approach?

I have been in full time employment in the UK since 2006 but I guess my financial situation is not taken into account in this case.

Thank you for your help in advance, any pointers appreciated!
