should the current employer know about my HSMP application?

Post by andy2007 » Sun Aug 19, 2007 7:35 am

Hi,
I am planning to apply for hsmp application. But while going thro the form I saw that the form asks to state full details of Current Employer with contact name , address , email , phone.

I would rather like the current employer not know about my hsmp because that would mean I am planning to leave the company in near future. The employer might see that as a bad sign and if my hsmp application gets refused then I will be in trouble with current employer.
The current employer might see it as lack of commitment to stay with the organization. It might also reflect in appraisals and annual pay hikes.

How should I handle this? Should I straight way tell my current employer that I am applying for hsmp.

Do the Home Office people *really* contact the current employer?

Please help. Thanks in advance.

Hi Andy,
If you can tell any of your managers who is good with you about your situation and take an experience letter from him, if at all the HO wants to contact they shall contact him, or if you just give your company details they could might end up speaking with any one from your firm.
HO doesn't always contact the firm.In my case it didn't.

Your employer will know it anyway if your application are picked for verification. But th HO will make sure that they contact it in legal way for the purpoose only for HSMP veirifcation documents. They will respect your privacy and legal right for Data Protection Act (DPA)

This is the thing U need to consider if U file up your application

Thank you herts and pantaiema for a speedy reply.

Hi herts,
one question on your comment,

I have already got a letter from employer(not directly from my manager ) that says

____________________________________________________________
To whome so ever it may concern
This is to certify that <name> , <designation> is an employee with us
since <joining date>

This letter is issued at employee's request.

____________________________________________________________
This letter is signed, sealed and current-dated on company letter head.

So the question is ,
Is this letter sufficient as an experience letter?

Another question is
Would it be enough if I just give the contact details of the person who signed this letter even if I may not know this person well. There by avoiding my manager knowing about this? (just a thought)

and Hi pantaiema,
One question about the comment
"This is the thing U need to consider if U file up your application ".
What should be my considerations in this regard?

Does addherence to DPA mean that HO people will not disclose the purpose of the verification inquiry, *if* at all they call/contact?

btw What is this Data Protection Act (DPA) ? There is no mention of this in the "HSMP: Guidance for applicants" pdf? If possible could you elobrate on this?

Thanks again.

hi andy,
your experience letter is good, should be allright.
Anyway andy if at all in worst of the worst case your manager comes to know that you are applying for hsmp whats the harm. Nowadays many people are applying for immigration all over the developed countries. If anyone asks you just tell him you have a dream living abroad, good quality of life. If they do harass you too much then change the company, thats what I can suggest mate. Dont worry much...

I mean U need to be aware that they will contact your employers once U apply for HSMP. If U do not want your employers know, then U should probably need to reconsider whether U need to apply for HSMP or not.

2. DPA (data protection act), they could only require information relevent to your HSMP application, they can not ask any irrelevant matter.
