non-ue national work permit for EU spouse not living in IE

Post by sovtek » Mon Aug 20, 2007 1:54 pm

I've been trying to get my work permit renewed for a few months now. I received one two years ago on the basis that I was married to an EU national that was not living in Ireland. It had no means test or a fee. Last year ENTEMP renewed without question. This year they are asking for original documentation and in addition for a letter from EU spouse's employer in Ireland.
I have asked around and this type of permit seems to be rare. Hence I suspect that they are actually confused at to what permit I'm applying for. I'm afraid to tell them that my EU spouse is not actually in the country and take a chance of them refusing it. Anyone have the same permit and what did you do? Any advice?

What is your nationality and your spouse's nationality?

Was your spouse not living with you when you first applied for the work permit in Ireland? I am surprised you received one when Directive 2004/38/EC usually applies to accompanying family members of E.U citizens.

Unless someone else disagrees, the only option I see for you would be your employer applying for a work permit/green card for you.

Yes they do/did have a work permit for non-eu married to EU national working abroad. You can't find it on the website now but it used to be there and I was granted two of them in succession. I've also applied for LTR about 4-5 months ago...but recently found out that it will be next year before processed.

Just for clarity. I have been living in Ireland since 2000. I was on a work permit for 3 of those years and living with my then girlfriend, A German national.
We got married at that point and I got a stamp 4 for my 4th year in Dublin. I then moved back to South Africa for one year with her. We then decided to move back to Dublin with me coming over first to get a job. They would not give me a stamp 4 but did give me a visa to stay in Ireland. I then got a job and found that you could get a work permit based on being the spouse of an EU national that was living/working abroad. I applied and got it. I then renewed it last year without any questions asked.
