Tier1 General + ILR + Dependant

Post by VijayUK » Sat Oct 04, 2014 8:11 am

Dear Gurus and Senior Members,

Please have a look and let me know what is the best scenario.

Main Applicant :
Initial Entry to UK with Tier1 General - Jul 2010
Total Number of Days Out of UK- till Date - All personal - 170 days ( Only One time 89 days at a Strech..rest all 3 weeks etc )

Dependatn : Initial Entry to UK with Tier1 General Partner - March 2013
Total Number of Days Out of UK - 122 in 1st year( Mar 2013 - Mar 2014 ) - All Business Trips
127 in 2nd year till now ( Mar 2014 till date ) - All Business Trips, and no plans to go out of UK for more than 20 days this Year.

Can the Main applicant apply ILR in May 2015 ? What Visa should the Dependant apply then ? Would it be good to apply as tier1 Dependant or Should change the status to FLR ?

Cheers
Vijay

Its better to apply Tier 1 G dependent visa for your wife in this way she will secure her 2 years already spent time in UK and eligible to apply ILR after 3 years.
But if she applied FLR M her continuous residence clock will
reset and she have to wait 5 years to become eligible for ILR

Thanks Malik...and rest all is Ok ?

Should the main applicant go for another extension or ILR is Ok ?

Reason is they are not accepting the applications after April 2015.

I can't see you need another extension your all absences less than 180 days . You can go for ILR without any problem.
