British Citizenship for EU Citizen

Post by Jersey » Fri Oct 10, 2014 11:24 am

Hi There

I have arrived beginning of December 08 to the UK and got the Blue Card (registration certificate), on Dec 13 I applied for PR and got it on February 14.

My 1st question, can I apply for naturalisation in December 14 (presumably I didn't have to apply for PR so effectively in Dec 14 I'm living lawfully for 6 years and exercising treaty rights).

2nd question, I have previously completed a Masters degree at a top UK university, does it give me exemption from English test (considering the level of english required in my degree was very high).

3rd question, I understand I need to take the Life in the UK test, when can I do it. Before or after application for naturalisation?

Many thanks.

Hi,

1) Yes, you can apply in Dec, however, if you apply at this time you will again need to include evidence that you have been exercising treaty rights for 5 years. If you apply in Feb, this will not be required as you have your PR confirmation.

2) A UK master's degree will suffice.

3) You need to do the test before you apply and include the original test certificate in your application.

Hope this helps :)

Thank you for your help. Regarding 1st question, I already proved that I exercised treaty rights for 5 years and based on that got the PR stamp. The only question is should I wait for February or can apply in December this year?

If you want to use the PR confirmation as evidence in your naturalisation application you will need to wait until February to apply.
The reason for this is that the PR confirmation only contains the issue date but does not contain the date you actually obtained PR.

Thanks again. It is a bit confusing because you don't have to apply for PR if you are EU citizen, but then if you do apply and it takes them 2 months to issue it, the time should still count.
