Mistake on my MAINTENANCE FUND

I came into UK with Tier 1 General visa with the following analysis,
1st visa was issued on
(18/11/2008) - ( 18/11/2011) ,but i came into UK with my wife precisely on the( 26/06/2009 ), we spent six months and a week in Nigeria).We did our first Extension from (20/12/2011) - (19/12/2013).
We applied for our second Extension that would had helped to complete the five years required for the Indefinite Stay on the (04/12/2013).
The application was refused because i forgot to include my Maintenance bank statement,though i had the money for 121 days. we went to court, but the judge upheld the decision of the home office (he agreed that my lawyer later provided the statement but not at as the time of my application ,even when the date fell within the stipulated time of my application.The judge now gave me five days to appeal to upper tribunal at this date(12/07/2014).at this point ,ve spent five years lawfully in UK (26/06/2009) - (12/07/2014).
My lawyer now ad viced to put in Indefinite stay rather than the appeal. we later received confirmation later and we are asked to go for the Biometric, which we went for ,still waiting for the home office decision.
but my Employer had stopped my employment stating that i have to wait till the decision is made,they agreed that i have an application in progress.I have a mortgage and two children (both had in this country).
can some pls advice.Am i still in the right part or not ?
