Tier1 General Visa Extension

Post by UpendraBestha » Mon Nov 03, 2014 3:10 pm

Hi ,

My visa is up for renewal shortly. In order to save money on renewal fee, I was thinking of getting my (main applicant) visa renewed here in UK but getting my dependants (wife + child) visa renewed from India, since the dependant renewal fee is only £874 (outside the UK) and because we are going to India for a holiday in a couple of months anyway.

https://www.gov.uk/tier-1-general/overview

The question is, my wife and child are living with me in UK, So if I only get my own Tier 1 visa renewed in UK and wait for them to go to India in next month - will their existing dependant visa become invalid as soon as I get a new visa or will it remain valid until the expiry date mentioned on it?

Thanks for your replies/advice in advance

Regards,
Upendra

Hi Upendra,
I have done some research on this. Your dependents visa will valid until their leave to remain expire. So you can extend you visa with out impacting dependents visa.

If you are not concern about dependents ILR along with you, Then you can extend their visa from INDIA. But one solicitor confirmed me that, Before their current leave expire's, If your dependents able to extend their visa, No issues. But when i called UKBA on this, They told me that, UKBA will consider as new application. UK start will be reset, and they need spend another 5 years to qualify for ILR along with you. You can PM, if any help needed.

Regards,
Suresh.

Thanks Very much Suresh for your reply, very much helpful.

Its too risk to get it renewed for dependants from India as it impacts their ILR, its better to go for extension at one time in UK only.

From your Words, I understood that Main Applicant can process his/her visa first and then at later point of time (before Dependants visa expired) you can apply for their extenion from UK. Kindly correct if I am wrong in understanding your words.

Thanks
Upendra.

Hi Upendra,
If you are applying from UK, you can send their applications along with your application. But if you are planning apply from india, then you need to done your visa first. And then you need apply for your dependents from india.

Suresh
