my friend came to UK on Tier 4 visa with 10 hours working rights. then got extension tier 4 visa with no working right then he applied for Tier 1 Entrepreneur (200k) which was refused on general grounds. he appealed and won the appeal. now case is again with UKBA.
Does he has working right while the application is pending with UKBA.

I don't think so, if he had had no working rights on his last Tier 4 leave.
Moreover, when he is granted leave under Tier 4 (Entrepreneur), then it will be subject to 245DE(b).
