7 months to 10 years and Marriage on Entrepreneur visa

Post by wings.007 » Wed Nov 05, 2014 7:25 pm

Dear All,

I am on entrepreneur Visa and my 10 years are finishing in 7-8 months.

I am engaged for 8 months and I intend to marry before appliying for ILR for following reasons:

Requirements for spouce of person settled in the UK are tougher compared to dependents of entreprenuer visa.
Visa Processing time for my self is 6 months
Visa for my wife will take 3-4 months

I dont want to add further 10-12 months and long list of tasks before my marriage.

my question is:

Is it safe to go to and get married overseas and bring my wife with me?
Would I be troubled at heathrow immigration counter and immigration process?

what is best course of action at this stage.

Dear brother,

I am only going to advise you from my personal experience.
your concern is very true about bringing your wife here before you apply for your ILR.

other than the requirements of spouse visa on ILR it is also not hard to assume nowadays that even when you send your ILR application after 7-8 months you don't know when it is going to be approved. 1 month to more than a year is possible and very common now as UKVI is not willing to giveaway any visas that easily now adays.

the best idea i can think of is you get the nikkah done on phone( for visa purpose at least) get the name of ur fiancee changed and visa applied and only then you go back to get married formally (even get a live nikah again if you have to).
and only go out and come back once with your wife.
getting married first and then applying for her after coming back here theoretically is simple but you never know what is going to get you stuck somewhere.

Also when you go out make sure you are 110% prepared for any kind of tough interview on your way back.

IF you like my response and is helpful in anyway or not...please pray for me

Dear Brother,

Thank you very much for your kind response and effort to guide me in a right direction. I appreciate a lot what you have said and I will pray for you. I do understand how frustrating and annoying it is to get stuck in the middle of nowhere.

I am only worried because lot of my friends are doing nikkah over phone and calling there wives here without going to Pakistan.

I had an aunt who is a tier 2 dependent for 3-4 years and last time she returned she and her 2 children were held 6 hrs and asked all sought of questions. I was thinking why would they even ask her any question at all as she is a dependent and dont know how his husband goes about his VISA. only thing is that they are left with 7-8 months for their 10 year visa they came 1 month before me.

I will probably apply dependent VISA on Ent Visa by doing nikkah over the phone, and probably go after 5-6 months and return with my wife and apply ILR once here.

Thanks very much

Don't get nikkah over the phone, ukba is not going to accept that, because while applying the case, u need to attach your ticket during the time u get your nikaah, I recently got my wife visa within 5 working days, its simple PBS don't make your application complicated. you have to attach photos, whatsapp conversation or viber or tango or any proof of communication. its not necessary but most cases they point out refusal point that not enough communication.

hello,

thanks for the reply, few friends have applied and provided proof of communication and nikkah evidence i.e.nikkah nama.

should i be cautious to not apply on telephonic nikah, as i want her to come back with me on same flight and want to ensure that she has visa when i come back rather than applying there and stay in dark and suspense of she will get visa in time.

please advise why would nikkah on phone not accepted, or if this nikkah is on skype or video confrence ?
