Inshallah my hubby will be submitting all paperwork for his application next week at Mirpur.

I just wanted to know what to expect when he gets there. E.g what happens inside they check the papers you've submitted/tb test what else?
Is there anything else he needs to take with him?

I think they are picking one application from august ,one from may ..then from august then from may ..and Thats how tHe story goes ..this tactic will Keep their stats acceptable.

Hi

Can someone explain if the case is with the ECO and assessment has been completed but further checks are conducted... Meaning if its on final decision stage then why would it take them long to do so.... Any suggestions

I think ECO have reviewed the case and requested further checks, once those checks are done the ECO will review the results and proceed accordingly. There isn't any definite time, but INSHA'ALLAH soon.

Does anyone know if BHC call on weekends as my wife had a missed call from this number 051 5599, when she rang back it didn't work. Does anyone know if this is the BHC number?

Hi

I know that checks such as hmrc employer banks etc are done by another department, then the application is in a qeue for ECO to assess accordingly. The checks thats are carried out by ECO is only TB and ENGLISH TEST.. After these cheks are completed then final decision is made

They asked for original bank statements (first I submitted printouts of pdf bank statements) and wage slip of a months that I missed submitting before :(

You are very lucky, on most cases they would just refuse the case and make you appeal. Shows there are some Eco's which use there commonsense

Like I said, you cannot get WTC unless they believe you are earning too low... for this year. It is an estimate of your CURRENT years salary that they base it off.

Yes, BIG problem!!

Child tax credit and child benefit is different - childs entitlement.

Working tax credit you'll only get if your income is low. Sub 18k.

And if you get working tax credit, it means you do not earn enough to survive on your own job - no chance of getting spouse visa. Your case will be rejected without even looking!
Um I think ur forgetting the only way of applying is not through meeting the 18k and if anyone is niave enough to get a answer on a forum and no where else clearly has no sense

Yes you're right ! I do feel myself to be very lucky cux they have been following up with me, calling n emailing me ! Mashallah se ! But do u know how long would they take now to give a decision for my application? :(

They have to use this initiative, it's in their rules (only IF they believe such evidence is highly likely to enable a positive decision).

If a case collapses due to this, alone, it would be overturned in the review and BHC/UKBA can be sued.


Talking of case processing problems...

UKBA had issued guidance for how to complain and the types: https://www.whatdotheyknow.com/request/ ... ted.v1.pdf

Chief Inspector report outlined major flaws and serious misconduct and delays in case processing (including losing docs).

UKBA then replied (good read for us - shows what ICI complained and what UKBA then accepted as faults):

This was a review of UKBA case, complaints and correspondence handling back in 09-10, where it was made clear, applicants wronged could get compensation (and how). We need an audit now, in 2014, urgently.

th3, It's a strange process. When my wife submitted her documents after 2 weeks we checked the status and the UKVI replied with 'further checks/enquiries are being conducted' - This stayed pretty much like this till August, when I complained to the home office in september, they contacted ISB, and they said that due to the back log etc, it was in the queue to be processed.., then after that, it wasn't seen by an ECO until last week Friday. Again, the status was 'further checks/enquiries'. My wife got an e-mail today that it's been processed and she should wait for collection information.

Then you have some good news and am very happy that it turns out good for you!!

After initial checks, ECO gets it, and then orders the further checks -> then leaves it until he/she wants. That's my problem with the BHC.

Hi guys can you pls help me. I have been working for this company for over 2 years now. However my company is to TUPE which means it is to transfer my employment to a outsourcer. I have been told under TUPE law it means my length of employment will carry on. However I wanted to apply for spouse visa in April. Can somebody pls explain what is the right thing to do. Option 1 When I TUPE over to the new company should I wait 6 months with the new company as to not complicate the visa process, or apply earlier but mention the TUPE law and apply that way. I will most probably have 2 P60s too. Reason being I understand you have to be employed by the same employer for 6 months, and when I TUPE over Im with a new employer I guess so I don't wana give them a excuse for refusal. Pls help guys. Thanks in advance
