Benefits After ILR - Difficulties

Post by WP2ILR » Wed Nov 19, 2014 7:09 pm

Hello , Please help me with the information.
1. My wife attitude TOTALLY changed and keep abusing me and arguing with me after getting ILR ( as I have applied for my family me, my wife +2 kids) spending lot of money.
2. Now she keeps threatening to take Benefits. I am not at all interested to take benefits as I am an IT contractor and working and getting enough money. If i take benefits, it may impact my IT Contracting jobs or credit history.
3. Also, she thinks if I give her divorce, she will get alot money from my end also good money for the maintenance funds - which she does not deserve at all. ( Kids are exceptional ).
4. In this situation, kindly help me what are my rights ?
5. I am thinking to leave the UK for few months ( 3 -4 months ) and go to India and stay for some time . And she is reluctant to come along with me. And says, she will stay in the UK and will claim benefits. Or Is It worth give divorce in India?
6. Kindly, can you suggest me , in this critical situation what options, do I have?
7. or Shall I wait and apply for the British passport and take the passport and go to another country and live there ? Even after that , do I need to pay for my wife's expenses?
8. Unfortunately, I did not see these posts before applying for ILR. Otherwise, I would not applied for my wife's ILR.
9. Appreciate your help on this...

The first thing you need to do is separate the marriage issues from the immigration/benefit issues. Only you can decide what to do about your marriage but remember, she is the mother of your children and the children should come first.

She can claim for whatever she is entitled to claim. Most benefits are means tested anyway so only once she applies will she know what she is entitled to, either as a couple or if separated, claiming on her own.

Claiming benefits will not affect your credit history or your job if you claim what you are entitled to.

You need to remember that as she now has ILR, she is no longer dependent on you and could stay in the UK forever and apply for Citizenship if she chooses, whether you remain here or not.
