Applied 27/02/2014.

The contract letter mentioned the rate i was being paid at per hour including the minimum hours im expected to work. It also states i will be expected to work some overtime when asked to.
Ye, it seems like im going to have to request another letter which states what they want.

Does anyone know the difference between salaried and non-salaried employment? Im not sure if this may apply to me, because i thought that salaried employment means fixed salary and non-salaried is where your pay is not fixed and varies month to month because you are paid hourly?

How did u pay ur Tax on ur second employement ..did u come Thru hmrc ..
and also If ur wages varied..then they pick the wage slip whrre u made the least amount n multiply it with 12 ...so Wat was ur lowest wage slip?

yes tax was paid to hmrc automatically by employer.

No they did not take the lowest wage slip, they just added it up for the 6 months.
I dont think they take the lowest slip, unless they made the mistake because of the employment letter issue. In which case its all a big mess

As for employment letter - you are non-salaried so what you should have got your employer to state on the letter was that you are non-salaried and have earned the gross amount of £xxxx.xx in the last six months (dd/mm/yyyy to dd/mm/yyyy) this would have made it much clearer for the ECO.

For non-salaried they add up the total for the 6 months relied upon and divide by 6 and then times by 12 to get your annual gross earnings (whereas for salaried they take your payslip and divide by 6 and then times by 12).

I'm sure from your previous posts you stated you were paid cash-in-hand for a few months but did not deposit the exact amount into your bank account as reflected on your payslip? This alone could be a possible point for refusal.

It is best to re-apply but as you said you will not be able to re-apply for another 6 months. So you could try the appeal route and submit a employment letter addressing the issues in the refusal notice and just hope for the best. Good Luck

It looks like all previous cases are now being looked at and decided upon.

3 days ago had visa refused.
Reasons:
1. salary falling below £18,600.
But the ECO has made a mistake in calculating the wages so will appeal against this.

2. employment letter for 2nd job does not state my gross annual salary. The reason my employer did not put this is because i am paid hourly which can include any amount of overtime over the 12months and also the national minimum wage went up on some of my wage slips. The exact gross annual salary can not be determined beforehand employer told me. For this job each month i am paid a different amount depending on the hours.

Do you think the above explanation will be accepted?
Does anyone have any advice on how to argue against this?

The reason i am appealing not re-applying straight away is because i am changing jobs in around 2-3 weeks time. So would have to wait another 6months to re-apply.

Just wanting to clarify something.

Due to your 2nd job letter not mentioning gross salary, am I right in thinking that they pretty much disregarded the 2nd job altogether and then came to the conclusion that with your frist job alone you do not meet the requirement, and 2nd job letter is not correct so therefore it's a refusal?

Did they mention that using the first job alone does not meet the requirements?


What I'm trying to ascertain here is that if someone applies using 2 jobs, and if the 2nd job does not meet criteria, will they ignore it and base the decision on the 1st job alone? And if this doesn't meet income threshold, then this will lead to a rejection right?

But if someone applies using 2 jobs, for the sake of them working 2 jobs, and if ALL requirements are meet and exceeded using the first job alone, any if paperwork is outdated, such as the last payslip for the 2nd job, they will ignore this job totally. But it's all met with the first job, so this should be OK right?

This is so weird! Want your guys opinion. Last week tracked my wifes case and they said passed onto a higher authority etc (along those lines) for consideration or final decision.

I didn't think much of it however today my wife got a call from gerrys to come collect her passport. I have not received any emails saying it has been concluded etc and from what she has told me it seems a genuine call from gerrys as it was from the same number we was called from etc for my daughters right of abode.

I personally think it has been refused I was waiting for them to ask for additional documents such as sa302 form (self employed route) what do you guys think? Is it normal to not recirve any emails

u Never know ..as long as u given them your UTR number and unaudited account for the same financial year ..statement of account is important but its something they can get of hmrc as Well directly .. ..
did ur bankstatements reflects ur annual income.?
Also what other financial documents did u submit ..

I also didn't provide 12 months statement for both my accounts like an idiot! That's why I was under the impression they will ask for more documents everyrhing else financially is fine. Iv submitted my accountant papers, self assessment and all my tax is paid too.

The only issue is bank statements as they were not the full 12 months (ill advised by a solicitor) and sa302 form everything else is bang in order.

If I remmeber correctly I think 12 months business statements have been submitted and 6 months personal.

My bank statements reflect the income etc but I highly doubt a visa has been issued.
