EEA Family Visa

I make mistake, have husband on EEA (Poland) visa I arrived on EEA family visa, husband promised to extend visa but didn't, I have job and NI number but want to go study at home for 3 months now visa is wrong need to fix this but at Croydon they tell me to wait to appoinment and then tell me to phone, confused and desparate need a lawyer please

So, your husband is Polish? How ling has he been in the UK and is he working here? What nationality are you? When did you arrive in the UK? I'm not sure what you mean by visa is wrong. If you could post a few more details that would be really helpful; I'm not sure exactly what the issue is and don't want to give you wrong information.

Huband - Polish
Me - Ukraine
Both - working with NI number
Arrive Dec
Visa mine to April
Sent off passports to get verified to HomeOffice got them back for visit to study but no extension to visa

Sounds like OP was on a six month EEA RP which expired last April so I gather OP is now an overstayer.

When did you apply for the EEA RP extension? Before it expired or as I suspect, after?

Before it expired, husband sent both passports off, Ukraine was supposed to take 8 month but needed passport back, got it back last month nowcheck and see same visa with no extention

suits2me, seeing your posting makes me want to reply with... get visa only for 4 months why first? husband need visa, But he from Poland, no? Ask passport you back, so visa not extended. Not ask passport, and send passport visa will extended.

See where I am going with it. Your husband does not need a visa as he is Polish. I hope he has registered with the WRS and if you do not want to change your mind about wanting to stay here and do a course in English, then apply for the EEA Family Permit after you are done with your studies in the British embassy of which ever country you are going to study and then come over and make an application for the FMRS or the EEA2 form, depending on what your situation your husband is on.

I hope you can understand my answer.

Applied at british embassy Warsaw for Mult Visa BEFORE I came to UK in Nov 2006
Come to UK Dec 2006
Visa valid to April 2007
Feb 2007 apply to Home Office to extend my visa, have job, NI number
Home Office send my passport to Ukraine say will take 8 months
Study in Poland starts September 2007
Get passport back as need in for travel last month but no extension
Have to go back to study, worried

What I don't understand is why would HO send ur passport to Ukraine - so far as I can see Ukraine has nothing to do with it?

I have no idea - husband sent it in with forms something to do with checking the passport

Which visa were you granted? An EEA Family Permit or an ordinary Visit visa. Does the embassy know that you are married to Polish husband?

Why? If you do not have 'visa' (FMRS/EEA2) on your passport, you can apply for 'visa' (EEA Family Permit) from Poland, when you want to return back after your studies.

Or, are you having trouble getting visa for Poland from Polish embassy because you do not have a valid visa for UK?

I think everyone needs to calm down!

There is a language problem here, and suite2me I don't think anyone is trying to make you feel bad, they are just wanting to make sure that they know what has happened so that you can be advised.

Okay, so my interpretation is that you came to the UK on a visa as an EEA dependent, as you were married to a Polish man, and have applied for an extension. Even if the visa was actually as a visitor, it makes no difference if you have applied for the leave to remain on the strength of the married.

It is plausable that they have taken 8 months to decide an EEA application, but I agree that the referral back to the Ukraine is strange. perhaps they want to check your last visa, or perhaps there is confusion over the passport.

The questions I want to ask you are:

1) Have I understood the situation correctly?
2) When you took the passport back, did you withdraw the application?

It was never my intention to make you feel bad. I did take a dig at your poor English skills, but it was done in good humour and if you felt bad, then...
