Can my dependent living in the UK Settlement visa from India

Post by panky92 » Sun Dec 07, 2014 7:42 am

Dear All
First of all grateful for all the moderators and posters for enhancing my knowledge on the UK immigration question.

I have a few questions and would greatly appreciate a clarification

First came to the UK in Jan 2010 on Tier 2 ICT
Switched to Tier1 General in November 2010
Applying for ILR in end December 2014

1. My Dependants have been living with me for last almost 5 years. Can my dependents apply for ILR from India as we plan to go there in March 2015 ? I am looking at reducing my costs and hence this question.

2. I have a new born son for who didn't have an Indian passport yet and I am looking at a few options.
a. Either apply for a Registration and then a British Passport but problem is that I have approximately 80 days and I am not sure that all the 3 steps of registering for a certificate, getting the British passport and getting Indian visa would be possible.
b. Get Indian passport for my new born son and get his ILR dependent visa after we go to India. Is this possible to be done? Approximately how long does it takes to get the ILR?

Many thanks

Regards
Panky

1. ILE impossible for spouse. Spouse's settlement visa application would reset spouse's qualifying period for SET(M). Best for spouse to apply for ILR before travelling.
ILE possible for children when both parents have ILR.

2. a) Register UK-born child in the UK or India. Apply for British passport in India.
b) Possible for non-British UK-born child.

Thanks Vinny

For some personal reasons, we need to travel on 20th March hence, request to clarify onnce more.

For the below point

I have read that registration process can take 6 weeks to 6 months - is there a fast track registration process also available ?
Secondly British passport can also take a couple of weeks ? Is that right ? I am not sure if I will be able to get all these 3 step possible witin the approx. 80 days time that we have before we need to travel.

my alternative is that - I apply for an Indian passport for my new born, and then get him an ILR along with all of us (we are applying for ILR at the end of December) ? Kindly advise..

A very quick question and sorry if its really stupid question

Can my dependant apply separately. Problem is that my 6 months old doesnt have an indian passport yet hence me (main applicant) and rest of the family would like to apply before my son's passport comes through.

Kindly clarify

thanks
