Help with American GF in UK

Post by Keezer » Thu Dec 11, 2014 7:15 pm

Hey,im new here so if this is posted in the wrong area, i apologize.. long story short, me and my GF been dating awhile shes american im northern irish (UK) she came here in june got a 6month stay and she has to leave by sunday or next week (is when her visa expires)

Our problem is shes found out shes 3+ weeks pregnant and she is afraid to go home as we may not see each other for awhile, and so she would like to stay here with me so we can look after our newly announced baby...

can we do this? is there any way we can cause im not sure on the UK immigration but i know a lot about the U.S immigration...

Need help asap as we're stressing over this.. if she goes home to her family we may not see each other for quite some time and her parents arent to keen on the idea of having a kid at 18/19...

thanks

No way of extending a visit visa, they are only extended in extreme circumstances, and also you should be aware that if she overstays and has the baby in the UK, she'll be liable for the cost of the birth.

Are you an Irish citizen/passport holder or a British citizen/passport holder?

Which country do you live??

Easiest (and cheapest visa application) route would be marriage and living in EU country (Rep of Ireland or mainland Europe) other than UK and using the EEA Family permit/resident card route and then using the Surinder Singh route to come back to the UK.

She cannot switch from a visitor visa to any other category under UK immigration rules while in the UK.

Any EU state other than UK. Then apply under the more liberal EU rules. You'd need to be married though, can't do it unmarried partners as you'd need to prove a durable relationship which means two years cohabitation.

You'd have to shift your centre of life to the new EU state, thought that would be hard to prove against if you live in Derry for example now and move to Buncrana or somewhere....

Anyway, you'd need to do this for around a year then you can relocate back under the Surinder Singh ruling.
