Hi all,

Hopefully someone on the forum might have come across such situation can make some comments. Here is the situation: parents are on valid Tier 1 visa and have been living in UK for the past 3 years. It happened that we had a baby born outside of the UK recently and baby will be coming with us to the UK soon. Baby will be traveling on a US passport which doesn't require visa to enter or re-enter UK, however I'm wondering if i do have to actually apply for a child dependent visa and biometrics before traveling to the UK in this case. Are visa dependent rules the same for all nationalities and infants which should get visa prior to traveling? I remember reading somewhere, but that was mainly for babies born in the UK, that babies can apply for biometrics on the next parents application but meanwhile can enter/re-enter UK if they are on passport that doesn't require visa however i couldn't find affirmative information on this.

Baby will be coming to the UK to join family, not as a visitor, therefore apply for PBS dependant visa

My own daughter has US citizenship and I work with a lot of Americans, trust me rules are the same -- even though actual IO's at the border have slightly different process for non-visa national visitors, and usually reach first for a US passport in a pile for that reason

it is important to obtain a PBS dependant visa for the child, and to make absolute sure every time she enters that she is not given visitor leave by mistake, but is being admitted on her PBS leave (should get just a date stamp, not a stamp with additional words about six months and work prohibited)

that being said, people have been sucessfull in bringing American chlidren here as visitors without obtaining dependant visas for them, but overall rules about not using visitor leave to actually live here would apply, so this works best with school age children who can always say that they are actually in school in the States etc. Your baby can hardly claim that she will return to the states by herself after a holiday, so... but bringing her for a couple of months with a mumbled comment as to "we didnt have time to apply for PBS dependant but will be going back stateside in 2 month and definitely do that" may work and it has been done, since there isnt any danger of baby attending school in the UK either

the thing is, there is virtually zero chance of your baby being denied entry, as a family member of UK residents she is not immediately removable and entitled for provisional admission pending appeal -- and on top of that, justifying exclusion of the baby at least on the first visit would be almost impossible for them, as they can't really claim that the baby intends to illegally work or even study )

if the baby comes for 6 months, then leaves for a day and comes right back, that could be a problem obviously but you are not there yet. but overall I myself and other people in similar position who were simply trying to postpone paying a thousand quid for a US-passport-bearing child's dependant visa, report favorable attitudes from IO's
