Tier 1(G) extn..Am I eligible for ILR directly?

Post by pavanc » Sat Jan 03, 2015 1:38 am

Hi All,

I have a query regarding my ILR eligibility. I came to UK in 2011 in Tier 1 (General), following are my visa details:

Entry clearance valid from: 13-Feb-2011
Date enter into UK : 12-May-2011 (entered 89 days late into UK)
1st extension Valid from : 14-Feb-2014 to 13-Feb-2016

Now, my question is do I need to go for another extension now before tier 1 extn closes or can I go for ILR directly in 2016 Feb. My understanding is I may be eligible for ILR directly as my entry into UK is less than 90 days. But, not 100% sure. Can some one please help me understand my situation. Appreciate your time and response. Thanks

90 day concession (page22):
https://www.gov.uk/government/uploads/s ... eriods.pdf

The entry clearance stamp date is counted as the date of the start of the 5 year lawful residence not the Entry date in the UK itself, under the condition that the Tier 1 G migrant enter within 90 days of the EC.

28 days - (page 4)
https://www.gov.uk/government/uploads/s ... _11-14.pdf
Please do not send us your application more than 28 days before you become eligible to apply. If you do, we may refuse your application with no refund of the application fee (if a fee is charged for your application type). However, you must make your application before your current permission to stay in the UK expires.

So you can apply ILR directly 28 days prior to 13th Feb 2016 around from 16th Jan 2016 to onward you are eligible.
