Applying for spouse visa from Malaysia

Applying for spouse visa from Malaysia

Hi everyone,

I am a pakistani born national working over here in malaysia for more than an year now. I am getting married to a british citizen in july 2015

My question is Can I apply for my spouse visa from Malaysia which means without going back to my country as i work over here in KL ?

My fiance lives and work in UK.

You can apply in the country where you are legally resident. Should be fine to apply from Malaysia.

You say 'your fiance'. What exactly are you applying for? To apply for a spouse visa, you have to be married first unless you are applying for a fiance visa (6 months validity and you don't have right to work in this time and must get married in this time and then apply for spouse visa in country).

Does your fiance meet the financial requirement of £18,600pa??

You can apply for Malaysia as well. But you can't apply for Spouse Visa until you have married already as they need proof of Marriage and etc etc. You can apply for Fiance/visit visa and come to U.K ... But in order to switch to Spouse Visa you might have to go back to Pakistan and re-apply. As on Family Visit visa you cant switch to Spouse Visa within U.K.

And also your wife has to be earning £18,600 Gross Annual Pay and must be with the same employer for the last 6 months of date of appliation in order to apply for Spouse Visa ( Category A )

If you apply for a fiance visa to marry in the UK you can switch to a spouse visa without leaving.

Hi CR001,

Yes I meant that my soon to be spouse will be applying for my spouse visa after my marriage in pakistan which is in july 2015. But I wasn't sure If I can get married in Pakistan and come back to Malaysia because of my work and continue the process here in KL ? Obviously my spouse will go back to UK after the marriage. But as you know leaving your job from Malaysia and sit in pakistan ( after the marriage ) because of the process made me feel like asking this question.

Yes, My partner meets the financial requirement.

Yes, she meets the financial requirement. I feel no advantage for applying the fiance visa and come back again for spouse visa process. Can I visit my spouse in UK during the process ?

So is it confirmed right that you can apply from anywhere ( outside my hometown ) for spouse visa? When they will be needing my passport during the process?

No, if you have a fiance visa, you apply to switch to spouse visa while in the UK (do not confuse fiance visa with the marriage visit visa, the second one meaning you cannot switch in the UK). You cannot work while on a Fiance visa though.

You need to apply in the country where you have legal residence, in your case Malaysia. Your wife cannot apply for you, you have to do it but she would need to provide the long list of documentary evidence. You submit your passport at the same time as the application and only get it back when the decision is made, so you would therefore not be able to travel while your application is in process, besides which, how would you obtain a visitors visa in which you have to prove you will leave the UK??

Why do I need a visitors visa and for what ? I am thinking that after the marriage i will apply my spouse visa in pakistan and leave my job from malaysia. So obviously staying in pakistan during the whole process and then move to uk on spouse visa. I am a software engineer with 5+ years of experience, getting a job is not such a big issue. I work online remotely too

Also, i am not looking forward for the fiance visa as they have made difficult now to convert it to spouse visa while being in the uk. So, its better to get married ( she will come to pk for marriage ) and then apply for spouse visa from pakistan.

You're mixing two different visa up,fiance's visa can be easily converted to spouse visa,while marriage visa can't be converted to spouse visa.
I understand you don't need it but need to correct the impression because of others reading this.

Hi, greatly appreciate Is there anyone can advise me that my fiance visa (settlement) granted and valid from
20th Dec 14 - 20th June 15.
However for some unexpected reasons we need to postpone the marriage date to 05th June 2015 which left only 15 days to switch/apply to spouse visa. Marriage will take place in the Uk and then switch it to spouse visa in Uk too.
Is it ok to postpone that long? Yes, I will go for premium service and expect same day decision if meeting the requirements.

I am still in Malaysia, Can I pre-book the apptment for Premium Service (in UK) for June 2015 NOW on-line?? Which website and what form to fill out?

As a Malaysian, do i need to take TB Test again to apply for spouse visa?? I did for fiance visa ut valid 3 mths only.
