Hi everyone

I need guidance from you. I had been an international student in UK since 2011. In May 2013 I got married to a British citizen in UK.The background is - his first wife had died due to meningitis in July 2012. Since then he was into severe depression and stress as he had 2 kids - a girl (now 10) and boy (now 3 years). He had stopped working as no one to look after his kids and himself. Then we met and we felt we could go ahead get married. Things started to improve for him and he worked part time. he wasn't claiming any benefits except for child benefits. At that time we didn't know that he needed to show the income of 18600/year to apply for my spouse visa. So in October 2014, after knowing this he was again into depression and life got very complex for all four family members. we got into touch with a family support work from the council and she help us a lot to get back stability. She infact helped me search a lawyer also who to get help in applying for my spouse visa within UK at a reasonable fees.

now my question is - my husband, step daughter and step son all are British citizens. The girl has been in UK for over 7 years and she is 10 years now. So if I apply for my visa based on 7 year old child concession route what are chances of getting visa? Should I go for it (my student visa expires in Jan 2015)? Though my husband has stated working his income isn't enough. we have got all his medical reports from GP and mental health advising team as well as support of the family support worker of the council. the lawyer told me mine is different case but chances of getting visa depends on ECO.
Will it be a strong case? Are there good chances of getting visa?

You should succeed under the 10 year FLR(FP) route, due to the children, and this will exempt you from the Financial requirement.

Step Children are considered as child, under the route if their other parent is dead.

In any event you have a genuine and subsisting relationship with those children and it will not be reasonable for them to relocate to your home country.

thank you so much for your reply. I have collected all documents, medical report of my husband, children's school reports, family worker's letters. somehow i was very tensed and doubtful and then I came across this board. I had been reading posts and finally thought of getting advice from you all as mine was different case. I am now relieved and feeling confident about the application.

So please pray for me that all goes well with my application and i get positive results.

hi there!
I have been reading all your posting and find them quite informative..I am facing a situation where by my partner has been granted 3 years as she had a child with a british Citizen ( on the basis of family life). their relationship ended and we are now together. We had a baby 2 months ago and she is due to apply for Indefinite leave to remain in 2 years. I personally came as a student few years ago and along the line lost my right of residence. Is there any application out there on the basis of family life that can favor me?
