What if relationship ends

What if relationship ends

i married my Indian partner in 2013 and we applied for a spouse visa that was refused, basically on a small technicality. We are now submitting an app on the 5/10 year route on basis of family life, through a solicitor. Obviously it may be refused. My question is though, if it's granted will it be on the basis that the marriage continues? We're having some problems and I'd like to know the situation. I could ask the solicitor but I don't really want to tell her we're having issues. Thanks

Do you have children? If you do, this would alter the nature of the application (to maintain access to the kid/s).

If you don't, their visa will no longer be valid, as it is based on being in a relationship with a British ILR holder/ citizenship.

Hi, no we don't have children and it's unlikely we will for various reasons. Thanks, I suspected that was the case but wanted to check.
Out of interest, do you know what would happen if he were to have an affair and make another woman pregnant? So he would have a child but not with his wife! That's not the case (I hope!) but the issues are fidelity related!

Dump the man and report him to UKVI before he's got the chance! Yes, he would in theory be able to make an application based on a child once it is born. Get him chucked!
