Tier 1 General dependant status

Post by spzenthil » Mon Jan 12, 2015 2:53 pm

Hi,

I am eligible to apply for ILR now and my wife came to UK on Nov 2012 so she has to wait for 5 years to qualify for ILR. The current Tier 1 dependant visa is valid till June 2017 and she will fall short by 6 months still, I was hoping to apply for FLR M after that but it doesn't look she can apply that either. What visa should be used for extending her stay to qualify for ILR?

Appreciate your inputs.

Thanks,
-Senthil

You can apply your ILR but She will continue her stay on Tier 1 G dependent until June 2017 and then extend her leave as Tier 1 G dependent once extension granted after 6 months she will be able to apply ILR.

Thanks Malik44. This is what baffles me, Is it not the Tier 1 renewal closed after April 2015? so it will be Tier 1 dependant visa renewal is still applicable?
I am no longer a Tier 1 visa holder, so how long the Tier 1 dependant visa will be valid for my wife? on what basis they will give the expiry date for the dependant visa?

I am trying to find the home office link which says this as well and couldn't find it so far.

Thanks for your replies so far.

Cheers,
-Senthil

There isn't any link that says that Tier 1 dependant route is closing because it isn't.

Thanks Vinny. Its bit clearer now. She will get further 3 years on Tier 1 dependant and can apply for ILR like me.

I believe it is the same for child as well.

If child was born in the UK, then s/he will be entitled to register for British citizenship directly after a parent is granted ILR.

Thanks Vinny. Child is born outside UK and applied for entry clearance after 9th July 2012. so I believe she also have to spend 5 years in UK before ILR.
