EEA1/EEA2 Application

EEA1/EEA2 Application

Hi

Hope someone can help.

My wife is norwegian and we got married on 28th July 07 in norway. My wife lived in norway prior to that but now she has moved to London and we are living together. I am on student visa which expires on 31st Sep 07.

My wife registered as self-employed recently although she has been working since . She does tele marketing and book keeping business and has been paid for her work for couple of clients recently. Her earning threshold will be in the range of 20k/year. She has not filed her tax returns yet but is in the process of doing so. Although she has applied for NI number but hasnt been given one yet.

On the basis of above:
1) Can we apply EEA1/EEA2 together?
2) List of evidence we are able to provide currently is:
- Her bank statemnt
- Copies of paid invoices
- proof of marriage

Knowing that my student visa expires on 31st Sep, should i get extension on student visa for the rest of my course or is it safe to apply for EEA amily permit with not a lot information available as of now i must admit.

PLease help - we both are scared to take any risks.

Yes.

Take a look at the EEA1 form. It lists the documentation needed for self-employment. As far as the NI number, does she have proof that she applied for one? I just applied for mine last week and they gave me a slip of paper confirming that I'd applied and told me to hang on to it until I got my number. Perhaps you could call the Home Office and see if that would be sufficient?

At this point the only question I can answer definitively is that you can make the EEA1/EEA2 applications at the same time. Whether or not you have sufficient evidence, I'll leave that to the experts

Re NI - when she sent the self-employment registration form she did mention she didnt have one. We phoned couple of weeks later to find out what was happening to the application we were told it was passed onto the manual processing team who would issue us an invoice every 13 weeks for NI contributions. We have not received any correspondence yet on the basis of which we could book an appointment for NI interview.

What concerns me is minimum 3 months worth of evidence required/prefered that she has been working ("executing her treaty rights") for my EEA2 application to be successful. But on the other hand by the time my application is assessed she would probably be in 5th working month.

We are confused and any guidance will help.

siddiqr, in theory, you will never be illegal in this country as long as your wife is employed/self-employed or exercising treaty rights in some other way. So, even if you were to wait and let your student visa expire, while you collect the required evidence needed to apply with the EEA2/EEA1.

Alternatively, if you donot feel safe that way, you can apply with all the evidence that you currently have and then wait for them to ask for further documents and hopefully by then you will have the required documents.
