How did I succeed?
1) I read the whole guidance and Case Workers guidance from the 1st page to the last page and did not expect people to read and tell me what is there
2) I studied people's refusal cases on this forum and make sure I did not make the same mistake, for example, where payment was made by my employer but employers name was not reflected on my bank statement, I got a letter from my bank and employer to confirm that it was my employer who actually deposited that money in my account
3) Even though I could have gotten a letter from my uni to proof my english ability, I wrote IELTS and scored 8.0/9/0 knowing that IELTS may become mandatory in the future, e.g for ILR

So what did you learn exactly, what did you do THAT you might not have done after studying from other people's mishaps?makon wrote:I just got another 3 yrs on top of my 1+3, and am safe till 2010 and hopefully I can apply for ILR next year!

Nice explanationmakon wrote:A lot of people have reported on this forum that their application have been refused because the salaries is shown on the bank statement as: SALARY, without their employers name. The case workers guidance says that where bank statement is used as evidence, the statements must clearly show that payment has come from employer. This is the reason I got a letter from my bank and employer to confirm that it was my employer who made the payment.
Also, come next year, HO are planning to adopt the Australian system and if you have looked at how the australian system works, people are given point for having IELTS certificate. I can only say that by writing IELTS instead of submitting bachelors deg cert and letter from uni I was trying to be a bit proactive cos you dont know what will happen next year
when I hope to apply for ILR
The taxable income on my tax clearance was less than my claimed earnings by £2500. So I did not tick the box against evidence tax clearance in the earnings evidence section. I only ticked the boxes for bank statement, payslips, and letter from employer. I categorically stated that I only provided the tc since it was a mandatoy requirement and that they should not use it as evidence. I also told them not to expect the figure on the tc to corroborate with the payslip because I was claiming earnings based on gross income but the tc only show taxable earnings (after deductions such as pension). I also told them that the tc did not cover the period claimed and therefore will never match up with my claimed earnings, and as such they not expect it to.
Where I thought that there would be ambiguity I asked our HR to clarify in their letter. For example, I work for a company that pay salaries every 4 weeks instead of monthly. Because of this, we are always paid 13 times in a year and this always results in being paid 2ce in Januaries. So asked them to mention this in their letter since HO may not understand why I was paid in January.
Basically, my advice to fellow immigrant is that before submitting your application, put yourself in the CW's shoes and try to scrutinise your application. Do you think there's any ambiguity you need to clarify? then do it. Remember the burden of proof is on you. They dont know anything about you so you have to try and make yurself heard even in yur absence.
I also mark asterik against my salary entry on my bank statement so that it could be easily seen among the multitude of entries. Please do not run the marker on the entry before you are accused of altering the figures. Just mark an * at the beginning and end of the line on, or just circle that line.
At the same time, I am aware that at times people still get refused even when they have tried their best but a lot of refusals I have seen here could have been avoided.
If anyone have any particular question, then feel free to ask and I will do my best to answer.
Good luck, my fellow immigrants!
This is the reason for one particular rejection I saw, the case worker said:So what did you learn exactly, what did you do THAT you might not have done after studying from other people's mishaps?
