Complicated case, please help!

Post by LMMW » Tue Jan 27, 2015 9:08 pm

Hi All,

A bit complicated situation I'm in now, please advise.
A short outline of my Tier 4 to Tier 2 visa application process below. Tier 4 expires on Jan 30, 2015.

Dec 09, 2014 - First application submitted
Dec 14, 2014 - First BRP letter received
Dec 19, 2014 - BRP taken
Dec 29, 2014 - Application refused (scores were not awarded for salary, wrongly entering 40 working hour instead of 39 on CoS)

Jan 22, 2015 - Second application submitted (with adjusted salary and working hour on CoS)
Jan 27, 2015 - Second BRP letter received
Jan 27, 2015 - BRP taken

My employer has been taken over by a foreign company, the deal went through on Jan 26, 2015 (2 days before my BRP was taken). My company has changed ownership with Company House and reported to HMRC. My sponsor contacted HO today, the advice was given is to report to sponsor SMS about the take over ASAP, and state my details and the application status.
My employer will report the change to sponsor SMS tomorrow. Is there anything I need to do or I can do at this stage? Is there a great possibility that they can refuse my visa because the change?
Many many thanks in advance!

Did you include an employment letter with contact details in your application bundle?

You can also email the home office (public.enquiries@homeoffice.gsi.gov.uk) about the takeover. The case worker will pick up the email even although he/she is unlikely to reply back.

Thank you kevb2014.

I called UKVI this morning, they suggested that in this particular case, it's my sponsor's responsibility to report the change. If I do want to inform them that my sponsor has informed me about the change, there is no harm to do so, however not necessary.
My sponsor has informed me that they added a sponsor note, as my CoS hasn't been used to explain the situation and I will be working at the same position.
I guess the only thing I can do now is to wait for them to decide.

Yh this is good news. We've got something in common here (waiting!) but you should get a decision within 2 months.

Good luck buddy!
