Ok, my question is about my friend. She entered the UK on a student visa 5 years ago but claimed asylum in 2013, unfortunately her asylum claim has been refused and her appeals have been exhusted. Home office basically has given her an order for deportation. She has a boy friend who is an asylum seeker and his case is still pending. He will have his case heard in court in March. They intend to get married, and they do not know if it is better to do this before his case is decided.
If they get married before March and let the Home office know that now shE is a dependant on his asylum case, if he is granted does it mean that she will receive her dependant visa automatically? Does home office accept this marriage? They do not want to do this in registery office, just a religious ceremony and a document that can be obtained in a mosque confirming they are husband and wife.
Or is it better if they do it after he receives his status? The problem with this is that she may have been asked to leave the UK and apply for a spouse visa, and she does not want to return to her country. Can she apply from the UK?
